SALES AGREEMENT

For the sum of $ _1000.00____and the following conditions:

This dog is guaranteed as follows:

To the best of my knowledge, this dog is in good health at the time of sale.  If, however, within 72 hours of the dog leaving my possession, a licensed veterinarian should find it to be suffering from a serious health defect or disease (except those due to injury or neglect), the buyer may return the dog, provided it has no problem other than those present at the time of sale and has not been exposed to any contagious diseases.  If returned within 48 hours of the problem being discovered with written proof of the problem from the examining veterinarian, the full purchase price will be refunded.  The buyer assumes full responsibility for the health, appearance, and temperament of the dog until returned.  The buyer is also responsible for all veterinary bills and transportation costs while the dog is in his/her possession.

            To be free of show disqualifying faults under the AKC and/or ASCA breed standard.  (Because of the multiple factors involved in the success of a show dog, no guarantee is given for the success of this dog in the show ring.)

            To be fertile and free of hereditary defects affecting its suitability for breeding up to 3 years.

THE SELLER AGREES:

            If the dog is unsuitable for breeding or show because of a hereditary defect, it will be replaced with a puppy/dog of equal value at no cost to the buyer (except transportation costs) upon proof of neutering or return.

THE BUYER AGREES:

            Not to sell this dog or its offspring to any commercial dog center or to anyone intending to breed for commercial resale.

            That the dog will have an OFA or OFA prelim (OVC in Canada) number and a CERF number before it is bred.

            To train, condition, and exhibit the dog in AKC shows in an attempt to earn championship points.

            If the buyer cannot keep the dog for any reason, the buyer may NOT sell or give the dog to anyone except the seller without written permission from the seller.

            If at any time, the seller finds that this dog is being mistreated, abused, neglected, or if the buyer does not neuter the dog by the agreed upon time, the seller has the right to repossess the dog and owe/refund NO money to the buyer.  The seller shall not be obligated to reimburse the buyer for the purchase price of the dog or any money spent on the animal while in the buyer’s possession.  The buyer shall be obligated to sign over ownership of the dog and provide all registration papers to the seller.  If the dog has suffered any physical, mental, or emotional damage due to abuse and/or neglect, the buyer shall be responsible for any and all expenses incurred to retrieve the dog and care for and heal it, plus a $1000 penalty paid to the seller.

            The buyer certifies by signing this contract that he/she is not acting as an agent in this purchase; that the buyer will not resell this dog to a pet store, guard dog business, or medical research facility.
